End User License Agreement

GRANT OF LICENSE

Jagware grants you (as an individual) a revocable, personal, non-exclusive, and non-transferable license to install and activate the Software on up to two separate computers for your personal and non-commercial use. If you have acquired a commercial or technician license from Jagware, this restriction may not apply. Any form of sharing of this Software or allowing others to view its contents violates this agreement. The Software cannot be made available on a network or be accessed by multiple users unless a multi-user license is obtained from Jagware.

COPYRIGHT

Jagware owns the Software, which is protected under copyright laws and international treaties. You are prohibited from removing or obscuring any proprietary notices, labels, or markings embedded in the Software.

USAGE RESTRICTIONS

You are restricted or not allows, to (a) reverse engineer, disassemble, decompile, decrypt, or otherwise attempt to derive the source code of the product; (b) alter, distribute, or create derivative works based on the Software; or (c) replicate (except for one backup copy), distribute, publicly display, sell, lease, rent, or otherwise exploit the Software for unauthorized purposes.

COVER CD DISTRIBUTION

Jagware permits the reproduction and distribution of its Software (evaluation copies only) within Cover CDs included in magazines, provided that Jagware Software receives a copy of the magazine containing the CD.

TERM OF AGREEMENT

This License remains in effect until terminated. You may choose to terminate it at any time by destroying the Software along with all copies. Failure to comply with any of the terms outlined in this Agreement will result in automatic termination. Upon termination, you are required to destroy the Software and all its copies.

WARRANTY DISCLAIMER

JAGWARE SOFTWARE DOES NOT GUARANTEE THAT THE SOFTWARE IS FREE FROM ERRORS. ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, ARE DISCLAIMED. CERTAIN JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON WARRANTY DURATION, SO THESE LIMITATIONS MAY NOT APPLY TO YOU. THIS AGREEMENT PROVIDES SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY BY JURISDICTION.

SEVERABILITY

If any provision of this License is deemed invalid, the remaining provisions will continue to remain in effect and enforceable.

LIMITATION OF LIABILITY

IN NO CASE SHALL JAGWARE SOFTWARE OR ITS SUPPLIERS BE HELD RESPONSIBLE FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR INDIRECT DAMAGES RESULTING FROM THE DELIVERY, USE, OR PERFORMANCE OF THE SOFTWARE, IF JAGWARE SOFTWARE WAS MADE AWARE OF THE POSSIBILITY OF SUCH DAMAGES, JAGWARE SOFTWARE'S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT PAID FOR THE LICENSE, IF ANY.

ACKNOWLEDGMENT

BY INSTALLING THE SOFTWARE, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. THIS DOCUMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN THE PARTIES, REPLACING ANY PRIOR ORAL OR WRITTEN COMMUNICATIONS OR AGREEMENTS PERTAINING TO THIS LICENSE.
